General Terms and Conditions for Participation in Fee-Based Academic Continuing Education Programs Offered by the THA
1 Scope
(1) These General Terms and Conditions of Participation apply to all fee-based academic continuing education programs offered by the Technical University of Applied Sciences Augsburg (THA), unless otherwise specified in the respective course description.
(2) The organizer is the THA department named in the respective course description (hereinafter referred to as the “Organizer”).
(3) These General Terms and Conditions of Participation supplement the currently applicable THA Fee and Tuition Statutes as well as the currently applicable THA Fee and Tuition Regulations. To the extent that these or other regulations under higher education law contain specific provisions, such provisions shall take precedence over the General Terms and Conditions of Participation.
2 Registration and Conclusion of Contract
(1) Registration generally takes place electronically via the online registration portal provided by the Organizer or in the form specified in the respective event description.
(2) By registering, participants submit a binding offer to enter into a participation agreement.
(3) The participation contract is concluded upon confirmation of registration by the organizer.
(4) If the number of available spots is limited, registrations will generally be processed in the order in which they are received.
3 Participation Fee and Payment Terms
(1) The participation fee published in the respective event description shall be charged in accordance with the applicable Fees and Charges Statute and the applicable Fees and Charges Regulations.
(2) The participation fee is due as specified in the invoice and must be paid in full without deduction within the payment period stated therein.
(3) If a participant defaults on payment of the fee, he or she shall be excluded from further participation in accordance with § 6(3) of the THA’s Fees and Charges Statute, as amended.
(4) Outstanding claims may be asserted in accordance with applicable statutory provisions.
(5) Certificates of participation, transcripts, certificates, or comparable documents will generally be issued by the organizer only after the participation fee has been paid in full.
(6) The specific scope of services (e.g., seminar materials, digital learning materials, exam opportunities, etc.) is set forth in the event description.
4 Withdrawal by Participants, Withdrawal Fee
(1) Withdrawal from the participation agreement must be made in writing or in text form. The date of receipt of the notice by the organizer shall be decisive.
(2) In the event of a withdrawal, the following fees will be charged, unless otherwise specified in the respective event description regarding fees:
- up to and including 14 calendar days before the start of the event: free of charge,
- 13 through 7 calendar days before the start of the event: 50% of the participation fee,
- 6 calendar days or fewer before the start of the event: 80% of the participation fee,
- in case of no-show: 100% of the participation fee.
The hardship provisions of the currently valid fee and charge regulations remain unaffected.
(3) Participants are free to prove that the organizer incurred no damage or significantly less damage than the respective flat rate assumes. In this case, only the proven, lower amount of damage is to be reimbursed or paid.
5 Substitute Participants
(1) A substitute participant may be designated free of charge up until the start of the event.
(2) The substitute participant must also register for the event via the provided online registration portal, accepting the applicable General Terms and Conditions of Participation, and must specify (in the free-text field of the registration portal or, if not possible there, by email to the respective organizer) the participant for whom they are attending as a substitute.
(3) As soon as the substitute participant has paid the full participation fee, the organizer will refund the participation fee to the original participant.
6 Changes and Cancellation of Events
(1) The organizer reserves the right to cancel, postpone, or make organizational adjustments to events for good cause.
This applies in particular:
- if it is not possible to conduct the event in a financially or organizationally sound manner,
- in the event of a speaker’s cancellation,
- in cases of force majeure,
- for safety reasons, or
- due to other unforeseeable, compelling circumstances.
(2) The organizer is entitled to replace speakers, change event locations, or make organizational adjustments, provided that this does not significantly impair the content and overall character of the event.
(3) Registered participants will be informed immediately of any changes or cancellations.
7 Refunds
(1) If the organizer must cancel an event, any participation fees already paid will be refunded in full.
(2) If an event is rescheduled, participants will be notified. If they are unable to attend the rescheduled date, the participation fee already paid will be refunded in full.
(3) No further claims—in particular for reimbursement of travel, lodging, lost wages, or other consequential costs—shall exist, to the extent permitted by law.
8 In-Person, Online, and Hybrid Events
(1) The specific format of the event is specified in the event description.
(2) The organizer reserves the right to change the event format in whole or in part for good cause (e.g., from in-person to hybrid or online, or vice versa).
(3) To participate in online events, participants are responsible for providing the necessary technical equipment and a sufficient internet connection.
(4) Access credentials for online events may not be shared with third parties. The participant must ensure that unauthorized third parties do not participate.
9 Certificates of Participation, Proof of Completion, and Certificates
(1) Upon successful participation, the organizer will issue—depending on the event format—a certificate of participation, a transcript of academic achievement, a certificate, or comparable documentation.
(2) A prerequisite for the issuance of the respective document is the fulfillment of the requirements specified in the event description and/or in the relevant higher education regulations in their currently valid versions (e.g., Study and Examination Regulations (SPO)), in particular, but not limited to, regular attendance and/or successful completion of coursework. To the extent that higher education regulations (e.g., SPO or other bylaws) exist, these shall take precedence over the course description and these General Terms and Conditions of Participation in the event of a conflict.
10 Course Materials and Copyright
(1) Seminar materials, digital learning materials, and other course content are protected by copyright.
(2) They are made available to participants exclusively for personal use within the scope of the respective course.
(3) Reproduction, publication, modification, or disclosure to third parties is prohibited without the prior consent of the organizers and/or the respective rights holders.
11 Liability
(1) The THA is fully liable in accordance with statutory provisions for damages resulting from injury to life, limb, or health.
(2) The THA is liable for other damages only in cases of willful misconduct or gross negligence.
(3) In the event of a breach of essential contractual obligations (cardinal obligations) due to slight negligence, liability is limited to foreseeable damages typical for this type of contract.
(4) The statutory liability provisions remain unaffected in all other respects.
12 Data Protection
(1) Personal data is processed exclusively in accordance with applicable data protection regulations, in particular the General Data Protection Regulation (GDPR) and the Bavarian Data Protection Act (BayDSG).
(2) Information regarding the nature, scope, and purpose of the processing of personal data, as well as the rights of data subjects, is contained in the privacy policies of the respective organizers and the THA, as amended from time to time.
(3) The currently valid privacy policies are available on the websites of the organizers and the THA.
13 Language of the Event
(1) Events are generally conducted in German.
(2) Unless expressly stated in the respective event description, events may be conducted entirely or partially in another language, e.g., English.
14 Final Provisions
(1) Should any provision of these General Terms and Conditions of Participation be or become invalid in whole or in part, the validity of the remaining provisions shall remain unaffected.
(2) The laws of the Federal Republic of Germany shall apply.
